Terms & Conditions
The following terms & conditions apply to any and all forms of “business transactions” between the “client” and Leisure Pool & Spa Supply, Inc., it’s subsidiaries, and sub-contractors. “Client” is defined as; any person or persons, governmental agency, or business entity either public or private who engages in direct commerce with Leisure Pool & Spa Supply, Inc. “Business transactions” are defined as, but limited to; online sales, in-store sales & pickup, over the phone sales & support, service calls, service and (or) maintenance agreements, bacteriological water testing services, delivery of goods, shipping of goods, etc. By visiting this site and (or) doing business with L.P.S.S. Inc., its subsidiaries, or agents.. you agree to the following terms and conditions:
Credit:
Establishing Credit. Any potential new client who wishes to establish credit, a credit application must be properly completed and submitted for review. After review and approval of said credit application, credit will be issued with net 10-day terms. Net 30-day terms will be issued upon good credit history for qualifying accounts. Past due invoices will be charged a 2% finance charge. Any account past due 60+ days will be suspended until brought current. Until submission, review, and approval of a credit application, all clients and (or) accounts will be on a cash on delivery (C.O.D.) status.
Change Of Ownership. Any business entity, public or private, whose ownership changes hands must submit for review, a new credit application regardless if the business entity had established good credit under the previous ownership. Upon learning of any change of ownership, that account will automatically fall to a C.O.D. status.
Payment:
Accepted forms of payment include; cash, check or money order, credit card, and PayPal. Bitcoin and other cryptocurrencies are not an accepted form of payment. Payment must be made is U.S. Dollars. Credit cards accepted are Visa, MasterCard, & Discover. Any returned check will cause suspension of the account as well as be charged a $35.00 processing returned check fee.
Special Orders:
Special orders require a 20% non-refundable deposit. On a case by case basis at the sole discretion of Leisure Pool & Spa Supply, Inc., some special orders may be required to be “paid in full” prior to the processing of said order. All special orders are final, non-refundable, and non-returnable.
Refunds:
Refunds will be issued on approved canceled orders. This is minus transaction fees for orders totaling above $75.00.
Returns:
Returns are accepted on select products within 30 days of original purchase date. Items must be in their original packaging with all original paperwork and be in retailable condition. Not all items are returnable including, Chemicals, Above Ground Liners, Above Ground Pool Kits, and Special Order items. L.P.S.S. reserves the right to charge a 35% restocking fee on returns.
Warranty:
Any and all equipment, parts, & products sold by Leisure Pool & Spa Supply, Inc. are subject to their respective manufacturer’s standard warranties. These warranties are the sole responsibility of the manufacturer. Leisure Pool & Spa Supply, Inc. or it’s representative agents do not express, imply, or guarantee any manufacturers’ warranties.
Leisure Pool & Spa Supply, Inc. provides a limited six (6) month craftsmanship warranty on labor for work performed during a service call. Twelve (12) month “craftsmanship” warranties on labor are provided for public works (governmental agencies) projects and on a case by case basis for projects performed for public and private business entities.
Shipping:
Standard Shipping. Orders are shipped best way from origin via one of our two preferred carriers, USPS and UPS. All orders are subject to a shipping surcharge equal to the cost incurred to process and ship the order. L.P.S.S. Inc. does not offer free or flat rate shipping on orders shipped via a 3rd party carrier.
Rush Shipping. Expedited, next day air, or second-day air shipping services are available upon request at the purchaser’s sole expense. Expedited shipping quotes can be made upon request. Orders must be received and processed by 2:00 p.m. EST in order to be eligible for same day shipping.
LTL Freight Service. Product and (or) equipment will be shipped LTL freight F.O.B. from origin. All LTL shipments from L.P.S.S. Inc. warehouse(s) will be shipped via R & L Carriers, Inc. The “ship to” location must be able to receive truck shipments. Truck shipments may need assistance with unloading and will require a signature. Lift-gate service is available for an additional charge. Shipping of hazardous material will be subject to the carrier’s Haz-Mat fee.
Catalog:
We produce an annual commercial pool equipment catalog of which every effort is made to publish the catalog with as accurate information and pricing as possible. If inaccuracies are noticed, please contact our corporate office. Due to market conditions, pricing may fluctuate throughout the course of the year. Current market pricing will override any published pricing.
Trademark & Copyright:
Leisure Pool & Spa Supply, Inc. and Premier Aquatic Construction dba, their logo, slogans, & variations thereof are Trademarked property of L.P.S.S. Inc. Use of names, slogans, and logos without the expressed written permission from L.P.S.S. Inc. is prohibited. The compilation of all content on this website, contained in our commercial catalog or in any literature produced is the exclusive property of this site’s owner and protected by U.S. and international copyright laws. Said content includes but is not limited to; text, logos, colors, slogans, images, videos, audio, downloadable forms, etc.
Bacteriological Pool/Spa Water Testing Service:
Starting December 1st, 2018 Leisure Pool & Spa Supply, Inc. will no longer be faxing back reports of the bacteriological test results to each property. Instead, each property may access their reports anytime via our new online bacteriological report access portal. To access the new online portal, you must register as a new user, here. Once registered, users may update their profile information here or access their report(s) by logging in here and simply entering their facility’s main phone number for the “ClientID.”
It is the sole responsibility of the aquatic facility to notify Leisure Pool & Spa Supply, Inc. twenty-four (24) hours in advance when a test is not needed. If Leisure Pool is not notified 24 hours in advance and stops on the property to collect a sample, you can notify the water technician not to pull a sample. However, the facility will be charged the normal rate for the stop. It is also the sole responsibility of the facility to notify Leisure Pool & Spa Supply twenty-four (24) hours in advance when ready to stop testing for the season or is closed for maintenance.
Invoices are billed monthly, due in ten (10) days, net thirty (30). All past due account(s) will be put on C.O.D. (cash on delivery) until the account(s) have been brought current. All accounts(s) past due thirty (30) days or more will be suspended until account is brought current. L.P.S.S. Inc. reserves the right to assess a “fuel surcharge” anytime fuel exceeds $3.50/gallon. Average fuel per gallon cost determined via www.gasbuddy.com/indiana. Leisure Pool & Spa Supply does not participate in Compliance Depot and (or) Ops Technology. We will supply W-9 & Certificate of Insurance to the facility and (or) property manager when requested.
Your facility will be assigned a route collection day and will be collected promptly on that day, each week. Any collection of a sample(s) requested by a facility that requires us to come on a day other than that facility’s route collection day, will be deemed a “Special Test” and will be subject to an additional Special Test Collection Fee plus your regular sample fee.
LPSS cannot be held responsible for delays caused by extreme weather.
